- Applicability
All rainbow design deliveries and services take place exclusively
based on the principles of the following general terms and conditions.
Deviations of any kind are only excepted in the event that rainbow
design gives written consent.
- Conclusion of contract
All products offered by rainbow design are subject to confirmation
and availability. To close a contract, our written confirmation
is necessary. This is achieved through the actual delivery of
the product or service and/or issuance of the invoice.
Information and promises given verbally, brochures and advertisement
claims of all descriptions, especially product descriptions, illustrations,
diagrams, samples, statements concerning quality, workmanship,
composition, service, use and suitability, as well as the dimensions
and weight of the contract goods are non-binding, unless explicitly
otherwise specified. They do not constitute grounds for warranty
or guarantee claims of any sort, as small deviations from product
descriptions are considered allowed, provided that they are not
unreasonable to the contract partner.
- Terms of delivery, delivery times, partial deliveries
Quoted delivery times are approximate times. Compensation due
to delayed delivery or non-delivery is categorically excluded.
rainbow design reserves the right to make partial deliveries.
Goods are shipped with the Deutschen Post AG, (German Postal Service),
or with a shipping agent of our choice. Shipping costs are dependant
on weight and distance. They are billed to the customer who is
notified at the time of ordering, or on conclusion of the contract.
Express shipping is possibly available against an additional charge.
In case of damages or loss of the shipped goods up until acceptance
of delivery, rainbow design will afford an equivalent replacement.
rainbow design reserves the right to appropriately ensure high
valued parcels, (usually from 500 € upwards) and to pass
the costs on to the customer. The customer must specifically state
in writing if he does not want transport insurance. In such cases,
the risk of damages or loss of goods is transferred to the customer.
- Conditional sale
The goods remain the property of rainbow design GmbH (Ltd.) until
they have been paid for in full.
- Prices and conditions of payment
The prices quoted in our price list apply at the time of ordering.
All prices are quoted without of value added tax. Customers in
Germany and within the EU will be billed the German value added
tax unless a VAT No. is submitted. Shipments outside of the EU
are priced net.
Offers or quotes are non-binding. The agreed upon prices arise
from the confirmation of order given by rainbow design. The prices
in the confirmation of order do not include costs and additional
shipping charges, such as postal charges, freight, C.O.D. charges
and insurance. These costs will be invoiced separately.
Invoices from rainbow design are to be paid without any deductions.
Where partial deliveries are made, only the proportionate purchase
price must be paid. rainbow design will charge the contract partner
6.5% interest on late payments.
Conditions of payment:
- private customers inside Germany, C.O.D.
- private customers outside Germany, bank transfer in advance
or Master / Visa card
- rainbow design dealers (national & international), per invoice;
payable within 20 days from receipt.
rainbow design reserves the right to stipulate, or exclude a particular
form of payment.
- Subject to availability
rainbow design reserves the right to withdraw from a contract
if it ascertains that the goods or services ordered by the customer
are no longer available.
Payments already received will be reimbursed promptly after withdrawal
from the contract.
- Warranty / Guarantee
Goods having obvious defects must be claimed for immediately upon
receipt. In these cases, rainbow design can choose to repair the
defective article; otherwise, the legal terms of warranty apply.
- Liability
rainbow design does not accept liability for indirect losses/damages,
such as collateral damages, loss of profit, including reimbursement
of such losses not caused to the contract goods themselves, but
to other equipment, property or persons arising from their use,
their impracticality, or similar.
- Export
When the contract goods are exported, the contract partner is
obliged to observe the German foreign trade legislation.
- Protection of privacy
When using the personal data gathered business connections with
it’s contract partners, rainbow design will observe the
Data Protection Act. rainbow design reserves the right to use
the attained e-mail addresses for distributing rainbow design
newsletters/promotions.
If the customer does not wish his data to be used for internal
purposes, he has the right to remove himself from the mailing
list at any time, by sending an appropriate e-mail to info@rainbowsuits.com.
- Place of jurisdiction
For the terms and conditions of business and the legal relations
between contracting parties, German legislation applies. The place
of jurisdiction for all litigation between the customer and rainbow
design is the registered office of rainbow design Ltd..
